Education Directory Terms of Use

Last Updated: September 8, 2026

These Terms of Use govern your access to and use of EducationDirectory.net and its related webpages, forms, content and services (collectively, the "Services"). EducationDirectory.net is operated by Ed Media LLC ("we," "us," or "our").

Please read these Terms carefully. Section 13 requires most disputes to be resolved through binding individual arbitration and includes a class and representative-action waiver and a waiver of the right to a jury trial. Section 10 limits our liability.

By clicking a button or checking a box where you are clearly informed that the action constitutes agreement to these Terms, or by submitting a form accompanied by clear and conspicuous notice that submission constitutes agreement to these Terms, you agree to be bound by them.

If you do not agree, do not submit a form or use the Services.

1. Eligibility

You must be at least 18 years old and located in the United States to use the Services.

By using the Services, you represent that:

You are responsible for independently evaluating any school, program, provider or service before making a decision or commitment.

When you submit information through the Services, we may use and disclose that information as described in our Privacy Policy and the disclosures presented with the applicable form.

Depending on the consent you provide, we or identified third parties may contact you by telephone, email or text message. Where expressly disclosed and authorized, communications may use automated technology, prerecorded messages or artificial voice.

Acceptance of these Terms does not itself constitute consent to receive automated calls or text messages. The consent disclosure presented with the applicable form controls.

Message and data rates may apply. Message frequency may vary.

Schools, education providers, advertisers, matching services and other third parties are independent from us unless expressly stated otherwise.

  • Transactions or relationships with you.

Information concerning third parties may change and may not always be complete or current. You should verify material information directly with the applicable provider.

The inclusion of a school, program, provider, advertisement or link does not constitute an endorsement, recommendation or guarantee.

5. Acceptable Use

You may use the Services only for lawful purposes.

You may not:

  • Violate another person's rights; or
  • Use the Services in violation of applicable law.

We may restrict or terminate access, disregard submissions, investigate activity or take other appropriate action if we reasonably believe these Terms have been violated.

6. Intellectual Property

The Services and their content, including text, graphics, logos, designs, software, databases, organization and presentation, are owned by or licensed to us and are protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, revocable, nonexclusive and nontransferable right to access and use the Services for personal, noncommercial purposes.

No ownership rights are transferred to you.

Third-party names, trademarks and logos belong to their respective owners. Their appearance through the Services does not necessarily indicate sponsorship, endorsement or affiliation.

7. Privacy

Our handling of personal information is described in our Privacy Policy, Privacy Notice for California Residents, and applicable disclosures presented through the Services.

Those notices describe our privacy practices and do not create contractual rights beyond those provided by these Terms or applicable law.

8. Availability and Changes to the Services

We may modify, suspend, restrict or discontinue any portion of the Services at any time.

We may change content, features, matching criteria and participating providers without notice.

We do not guarantee that the Services will always be available, uninterrupted, secure, error-free, complete or current.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE."

WE DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY AND SECURITY.

WE DO NOT WARRANT OR GUARANTEE ANY SCHOOL, PROGRAM, PROVIDER, ADMISSION OR ENROLLMENT DECISION, FINANCIAL-AID RESULT, EMPLOYMENT RESULT, LICENSING RESULT, EDUCATIONAL OUTCOME OR COMMUNICATION FROM A THIRD PARTY.

Some jurisdictions do not permit certain warranty exclusions. Where prohibited, these exclusions apply only to the maximum extent permitted by law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, OPPORTUNITY, GOODWILL OR BUSINESS, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.

This limitation includes claims relating to:

  • Your use of or inability to use the Services;
  • Information or content made available through the Services;
  • Any school, provider or other third party;
  • Communications from third parties;
  • Unauthorized access to or alteration of information;
  • Errors, interruptions or security incidents; or
  • Any other matter relating to the Services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO US FOR THE SERVICES DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

These limitations do not apply to liability that cannot lawfully be limited or excluded.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless us and our affiliates, owners, members, managers, officers, directors, employees, agents and representatives from third-party claims, liabilities, damages, judgments, costs and reasonable attorneys' fees arising from:

  • Information you submit without authorization;
  • Your fraudulent or unlawful use of the Services;
  • Your material violation of these Terms; or
  • Your infringement or violation of another person's rights.

This obligation does not apply to the extent a claim results from our own unlawful conduct.

12. Informal Dispute Resolution

Before initiating arbitration or filing a lawsuit other than an eligible small-claims action, the party asserting a dispute must provide the other party with written notice describing:

  • The party's name and contact information;
  • The facts giving rise to the dispute;
  • The claims asserted; and
  • The relief requested.

Notices to us under this Section must be sent to [email protected].

The parties will attempt in good faith to resolve the dispute for 30 days after receipt of a complete notice.

To the extent permitted by law, applicable limitation periods will be suspended during this informal-resolution period.

13. Binding Individual Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO HAVE A DISPUTE DECIDED IN COURT AND YOUR RIGHT TO A JURY TRIAL.

For purposes of this Section, the "Covered Parties" include us and our current and former affiliates, owners, members, managers, officers, directors, employees, agents, representatives, successors and assigns.

Except for matters expressly excluded below, you and the Covered Parties agree that any dispute, claim or controversy arising out of or relating to:

  • The Services;
  • These Terms;
  • Our privacy practices;
  • Telephone calls, text messages, emails or other communications associated with the Services;
  • Information submitted through or obtained in connection with the Services;
  • Any relationship between you and a Covered Party arising from the Services; or
  • Any other matter arising out of or relating to your use of the Services

will be resolved through final and binding individual arbitration.

This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16.

A. Administrator, Rules and Wyoming Situs

Arbitration will be administered by JAMS under the JAMS arbitration rules applicable to the dispute and the JAMS Consumer Arbitration Minimum Standards in effect when the arbitration is initiated, as modified by these Terms.

The legal situs of the arbitration will be Cheyenne, Wyoming, and the arbitration will be deemed to take place in Wyoming regardless of whether any hearing or other proceeding is conducted remotely or at another physical location.

Hearings may be conducted through written submissions, telephone, videoconference or in person as permitted by the applicable JAMS rules.

If applicable law or the JAMS Consumer Arbitration Minimum Standards require an in-person hearing to occur at a location reasonably accessible to you, the hearing may occur at that location without changing the agreed Wyoming legal situs of the arbitration.

Except for disputes concerning whether the parties formed an agreement to arbitrate and disputes concerning the enforceability of the class or representative-action waiver, the arbitrator will decide disputes concerning the interpretation, applicability, scope and enforceability of this arbitration agreement.

If JAMS is unavailable or unwilling to administer the arbitration, the parties will attempt to select another mutually agreeable arbitration administrator. If they cannot agree, a court with jurisdiction may appoint an administrator or arbitrator as permitted by law.

B. Starting Arbitration

After completing the informal dispute-resolution process in Section 12, a party may initiate arbitration in accordance with the applicable JAMS rules.

The initiating party must provide the other party with a copy of the arbitration demand.

C. Fees and Costs

Filing, administrative and arbitrator fees will be allocated according to the applicable JAMS rules, the JAMS Consumer Arbitration Minimum Standards and applicable law.

We will pay arbitration fees that we are required to pay.

Each party will otherwise bear its own attorneys' fees and costs unless applicable law or a valid claim permits an award of such fees or costs.

D. Hearings

The arbitrator may conduct proceedings through written submissions, telephone, videoconference or an in-person hearing as permitted by applicable rules.

The use of a remote hearing or an in-person hearing outside Wyoming where required by applicable law or JAMS rules does not change the agreed Wyoming legal situs of the arbitration.

E. Arbitrator's Authority

The arbitrator may award any individual remedy or relief that would be available in court, subject to applicable law and this arbitration agreement.

The arbitrator may award declaratory or injunctive relief only to the extent necessary to resolve the individual claimant's claim, except where applicable law requires otherwise.

The arbitrator will issue a written decision as required by applicable rules.

Judgment on an arbitration award may be entered in any court having jurisdiction.

F. Mass or Coordinated Arbitrations

The parties expressly agree that the JAMS Mass Arbitration Procedures and Guidelines in effect when applicable arbitration demands are filed will govern filings that constitute a mass arbitration under those procedures.

Those procedures supplement the otherwise applicable JAMS arbitration rules and Consumer Arbitration Minimum Standards.

Administrative coordination, batching, grouping or other case-management procedures permitted by the JAMS Mass Arbitration Procedures do not convert individual claims into a class, collective or representative proceeding.

Except to the extent permitted by the applicable JAMS procedures or required by law, each claimant's dispute remains individual and the result of one claimant's dispute will not bind another claimant.

G. Matters Not Required to Be Arbitrated

Either party may bring an individual action in an eligible small-claims court.

Either party may seek temporary or preliminary judicial relief where necessary to preserve the status quo or prevent immediate and irreparable harm pending arbitration.

Nothing in these Terms prevents a person from reporting a matter to a government agency or prevents a government agency from seeking relief where authorized by law.

Any claim or remedy that applicable law prohibits from being subjected to arbitration will be handled as required by that law.

H. No Class or Representative Proceedings

YOU AND THE COVERED PARTIES AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT OR CLASS MEMBER IN A CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING, EXCEPT TO THE EXTENT APPLICABLE LAW PROHIBITS THIS WAIVER.

An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim, except where applicable law requires otherwise.

Administrative coordination under applicable JAMS procedures does not by itself convert individual proceedings into a class, collective or representative proceeding.

I. Jury-Trial Waiver

TO THE EXTENT A DISPUTE IS SUBJECT TO ARBITRATION, YOU AND THE COVERED PARTIES WAIVE THE RIGHT TO A TRIAL BEFORE A JUDGE OR JURY.

J. Arbitration Opt-Out

You may opt out of this arbitration agreement by emailing [email protected] within 30 days after the date you first agree to these Terms.

Your request must include:

  • Your full name;
  • The email address associated with your use of the Services;
  • Your telephone number, if you submitted one through the Services;
  • A statement that you wish to opt out of the arbitration agreement in these Terms; and
  • The date of your request.

Opting out of arbitration will not affect the remaining provisions of these Terms or your ability to use the Services.

K. Arbitration-Related Court Proceedings

To the maximum extent permitted by applicable law, any court proceeding concerning the enforcement of this arbitration agreement or an arbitration award—including a proceeding to compel arbitration, stay litigation pending arbitration, confirm an award, modify or correct an award, or vacate an award—must be brought in the appropriate state court located in Laramie County, Wyoming, or the United States District Court for the District of Wyoming.

The parties consent to the personal jurisdiction of those courts for such proceedings, except where applicable law requires otherwise.

14. Governing Law and Venue

The Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement in Section 13.

Except where federal law applies or applicable law requires otherwise, these Terms and disputes arising out of or relating to them are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

Nothing in these Terms eliminates or limits rights or remedies that applicable law does not permit a consumer to waive by contract.

Any dispute that is not subject to arbitration or eligible small-claims proceedings must, to the maximum extent permitted by applicable law, be brought exclusively in the appropriate state court located in Laramie County, Wyoming, or the United States District Court for the District of Wyoming.

The parties consent to the personal jurisdiction of those courts for such disputes, except where applicable law requires otherwise.

15. Changes to These Terms

We may update these Terms from time to time.

Revised Terms will be posted with an updated "Last Updated" date and will apply prospectively.

Where required by law, we will provide additional notice or obtain renewed agreement before materially revised Terms apply.

A material change to the arbitration agreement will apply prospectively and will not alter the arbitration provisions applicable to a dispute based on events occurring before the change unless the parties separately agree otherwise.

16. General Provisions

These Terms, together with any consent disclosure to which you affirmatively agree in connection with the Services, constitute the agreement between you and us concerning the matters they address.

If any provision is determined to be invalid or unenforceable, it will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

If applicable law requires a particular claim or request for relief to be decided by a court, that claim or request will proceed as required by applicable law without invalidating the arbitration agreement as to remaining arbitrable claims.

Our failure to enforce any provision is not a waiver.

You may not assign your rights under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, transfer of assets, transfer of the Services or other business transaction.

Headings are for convenience only and do not affect interpretation.

Where permitted by law, you consent to receive agreements, notices and records electronically. You may retain a copy of these Terms by printing or saving them.
